Independent Contractor Agreement - Telemarketer
You acknowledge that you are working as an independent contractor with Seniorleads.
You will be responsible for the payment of all taxes from my income, and you understand that Seniorleads will not be responsible for taxes and is not withholding taxes from your earnings.
To be productive, you work hours that are most suitable for clients, but you choose your hours, and you work at your location. The company recommends hours between 9:00 am to 5:00 pm EASTERN TIME (6:00 am to 3:00 pm Pacific) to set the maximum number of demonstrations (appointments). Seniorleads recommends that this work be done a maximum of 4 hours per day.
Note that you are calling professionals who work business hours in their respective time zones. Therefore, calling at night or on weekends is not productive.
Seniorleads provides a script, a video presentation and answers to frequent concerns. You use these materials to uphold company quality standards. You will not state anything inaccurate or misleading.
You use your own phone, computer and Internet connection.
Seniorleads will supply access to their target lists of financial advisors and life insurance agents. You will receive 500 records at a time. You will request a new list a day in advance of when you need it. You will contact those prospects to register them for the Seniorleads demonstration. You will adhere to the Seniorleads script to maintain the quality and completeness of the presentation.
You are expected to get 1-2 appointments for each hour of calling.
You will be paid $20 per set and attended demonstration:
Seniorleads will send to the advisor a confirmation email immediately after you set the demonstration time, a 1-hour reminder email and a text message reminder 15 minutes prior to each demonstration. You have the option of calling each advisor prior to their demonstration with a reminder call “Joe, this is simply a courtesy reminder that our business development expert will phone you at (time) to demonstrate a method of gaining clients and to get your feedback if it fits your business.”
If the advisor cancels the demonstration before the demonstration time, there is no compensation. If the advisor does not answer the phone at the set demonstration time, there is no compensation. In such case, our business development expert will continue to call the advisor and if the advisor attends a demonstration at another time, you will be compensated.
Commission payment is made every Friday by Paypal (preferred), Google Pay or another online service you designate. Payment is on Friday for demonstrations completed for the past week ended Wednesday at 5 pm Pacific. For example, for demonstrations completed during the week period from Wednesday, April 4, 2018, at 5:01 pm to Wednesday, April 11, 2018, at 5 pm, commission is paid on Friday, April 13.
Any documents such as your annual 1099 form, you agree to electronic delivery at the email address you provide below.

Company agrees to provide to Contractor certain confidential and proprietary information. Contractor acknowledges that such confidential and proprietary information and materials (collectively referred to as "Confidential Information"), includes, but is not limited to, information regarding the general business operations, proposals, Contractor lists, database of clients and prospects ( including contact information and buying/prospecting histories), marketing strategies, financial information, plans, regardless of whether such information or materials are expressly identified as confidential or proprietary.
Contractor acknowledges that, regardless of whether such Confidential Information is prepared or generated by Contractor or Company, is provided to Contractor pursuant to this Agreement, or comes into the possession or knowledge of Contractor in some other fashion, such Confidential Information shall remain the exclusive confidential property of Company, except to the extent expressly authorized in writing by Company for dissemination. Contractor further acknowledges and agrees that all such Confidential Information constitutes trade secrets and/or valuable, proprietary information of Company as it is not generally known to the public.During the term of this Agreement and for so long as the Confidential Information is not generally known to the public, Contractor shall not use or disclose any of such Confidential Information to any third party (except as authorized in the course of employment) without the prior written consent of Company and shall take all reasonable steps and actions necessary to maintain the confidentiality of such Confidential Information. Company database of prospects and clients is a most valuable asset and cannot be copied or used in any way except as a Contractor of Seniorleads. This also includes marketing and sales plans, trade secrets, procedures and methods used by Company that are not to be discussed with others.
